1. Introduction
1.1. These terms and conditions ("Terms") govern your access to and use of the Capital on Tap Concierge Service (the "Service").
1.2. These Terms are in addition to our Rewards Terms and Conditions. All capitalised terms used in these Terms and not otherwise defined herein shall have the meanings assigned to them in the Rewards Terms and Conditions.
1.3. Access to the Service is made available to eligible Capital on Tap Pro customers and, in the case of Capital on Tap Experiences, to all eligible Capital on Tap customers as set out in section 11 ("you", "your") by New Wave Capital Limited (trading as Capital on Tap) ("we", "us", "our").
1.4. The Service is operated and fulfilled entirely by Go Privilege (the "Service Provider"), an independent third-party service provider. Any use of the Service shall be governed solely by the Service Provider's terms and conditions, save as set out in section 11. We are unable to guarantee the continued access or availability to the Service, therefore we reserve the right to cease providing access to the Service at any time without any liability to us.
1.5. The Service consists of three components:
- A complimentary Go Privilege Silver Membership (the "Membership"), which provides access to benefits and offers operated by the Service Provider;
- The option to use your Points as a payment method for certain goods or services ("Items") offered through the Membership; and
- Capital on Tap Experiences, which lets you use your Points for event hospitality packages that the Service Provider has reserved for us, as set out in section 11.
1.6. By using the Service, you accept and agree to be bound by these Terms, including any relevant terms and conditions set out by the Service Provider (including their privacy policy). You may be required to accept these separately to activate and use the Service.
2. Our Role
2.1. Our role is strictly limited to that of a facilitator. We provide you with complimentary access to the Service if you are an eligible Capital on Tap customer.
2.2. You acknowledge and agree that:
- We are not the provider, supplier, or operator of the Service, the Membership, or any goods or services (including the Items) offered through it.
- The Service Provider is an independent third party service provider, not an agent or employee of Capital on Tap.
3. Eligibility
3.1. To be eligible for and to use the Membership and Items, you must be an active Capital on Tap Pro customer in good standing, aged 18 or older, and a resident of the United Kingdom. Capital on Tap Experiences is open to all eligible Capital on Tap customers, as set out in clause 11.2.
4. No Warranties
4.1. To the fullest extent permitted by law, access to the Service is provided on an "as-is" and "as available" basis, without any representations or warranties (other than those which cannot be excluded by applicable law), and cannot be transferred, exchanged, sold, or redeemed for cash.
4.2. As we are not the provider, supplier or operator of the Service, we therefore make no warranties or representations of any kind, whether express, implied, or statutory, regarding the Service, the Membership, or any goods, services, or benefits (including the Items) obtained through it. This includes, but is not limited to, any implied warranties of merchantability, fitness for a particular purpose, accuracy, timeliness, or availability.
5. Third-Party Suppliers
5.1. The Service Provider may use various third-party suppliers (e.g., restaurants, hotels, ticket agencies) to fulfil the benefits and offers within the Membership.
5.2. Capital on Tap is not responsible or liable for the acts, omissions, errors, or negligence of the Service Provider or any such third-party supplier, including for any delivery, quality, or safety of the Service or any Items obtained through it, save for our obligation to reinstate Points under clauses 11.9 and 11.10.
5.3. Your interactions with the Service Provider and any third-party suppliers are at your own risk. Any dispute, claim, or complaint regarding the Membership or any Item must be directed solely and exclusively to the Service Provider or the relevant third-party supplier.
6. Costs, Payments, and Redeeming Points
6.1. While access to the Membership itself is provided on a complimentary basis by Capital on Tap, you are solely responsible for all costs, fees, taxes, and expenses associated with any Items you purchase or book through the Service (e.g., event tickets, hotel rooms, travel costs, merchandise).
6.2. Unless you opt to pay with Points (where available), you will be required to provide a payment method directly to the Service Provider or the relevant third-party supplier to cover these costs.
6.3. For certain Items offered through the Service, you may be presented with the option to pay for the Item in full using your Points.
6.4. The option to pay with Points is only available if your Points balance is sufficient to cover the entire cost of the Item at the time of purchase. Partial payments, where an Item is paid for using a combination of Points and another payment method, are not permitted.
6.5. If you select to pay with Points, the total number of Points required for the Item will be confirmed by you and then immediately and irrevocably deducted from your Points balance. All such redemptions are final and non-refundable. This clause does not apply to Capital on Tap Experiences, which are governed by section 11.
7. Limitation of Liability
7.1. To the fullest extent permitted by law, Capital on Tap, its directors, officers, employees, and agents shall not be liable for any loss, claims or damages of any kind, including but not limited to:
- direct, indirect, special, incidental, punitive, or consequential damages;
- loss of profits, loss of business, loss of data, or loss of goodwill;
- damages arising from personal injury or property damage,
arising out of or in connection with your access to, use of, or inability to use the Service, the Membership, or any goods or services (including the Items) obtained through it, whether provided by the Service Provider or by the relevant third-party supplier, even if we have been advised of the possibility of such damages. You therefore agree to release us from all liability, loss or damage or expense arising out of or in connection with your access and or use of the Services, the Membership, or any goods or services (including the Items) obtained through it.
7.2. Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence or for any other liability which cannot be excluded or limited under applicable law.
8. Data Privacy
8.1. To activate your Membership, we will need to share your personal information (such as your name, email address, and Capital on Tap account status) with the Service Provider. By using the Service, you consent to this sharing.
8.2. Once your data is shared with the Service Provider, their own privacy policy will govern their use of your data.
8.3. Our collection and use of your personal data are described in our Privacy Policy.
9. Termination or Suspension
9.1. Your access to the Service is contingent upon you remaining an eligible Capital on Tap customer in good standing.
9.2. We reserve the right, in our sole discretion, to suspend, amend, restrict, or terminate your access to the Service at any time, for any reason, without prior notice and without any liability to you. This does not affect any Capital on Tap Experiences booking that has already been confirmed.
10. General
10.1. These Terms shall be governed by and construed in accordance with the laws of England and Wales.
10.2. You agree to submit to the exclusive jurisdiction of the courts of England and Wales to settle any dispute or claim arising out of these Terms.
10.3. We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
10.4. If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will remain in full force and effect.
11. Capital on Tap Experiences
11.1. Scope. This section applies to event hospitality packages that we offer through the Capital on Tap Experiences page ("Experiences"). If anything in this section conflicts with the rest of these Terms or with the Service Provider's terms, this section prevails.
11.2. Eligibility. Any Capital on Tap customer with an active Rewards Membership can request an Experience, on any rewards tier. You must also be a UK resident aged 18 or over, and your Credit Account must be in good standing as described in clause 3.1 of the Rewards Terms.
11.3. Your request is binding. When you submit a request for an Experience, you are committing to redeem your Points for that package. You agree that if the package is available, we will deduct the number of Points shown on the Experiences page and confirm your booking, with no further step needed from you. Your request cannot be withdrawn once submitted. Only submit a request if you are sure you want to go ahead.
11.4. Availability and allocation. The Service Provider has reserved a fixed number of packages for each Experience. Requests are handled in the order we receive them. Once the allocation is used up, the Experience will be shown as sold out and we will not accept further requests for it.
11.5. Registration cut-off. Each Experience has a registration cut-off date, shown on the Experiences page. We will not accept requests after that date.
11.6. Checking availability. We will confirm whether your package is available within 7 Business Days of your request. If it is available, we will place the booking with the Service Provider on your behalf, deduct the Points and confirm your booking by email. You do not need to sign a separate booking form with the Service Provider. If it is not available, your request will lapse and no Points will be deducted. We only deduct Points once the Service Provider has firmly confirmed availability.
11.7. Points and account status. When we deduct Points, you must have enough Points to cover the full package, and your Credit Account must be in good standing. If you do not meet both conditions, your request will lapse and no Points will be deducted. Partial payment with Points and another payment method is not allowed.
11.8. Delivery. The Service Provider will send tickets and event information to you directly. Your attendance is subject to the terms and conditions of the event organiser and the venue. Please check your tickets when you receive them and tell the Service Provider about any errors within 5 days (bookings@goprivilege.co.uk), as errors reported later may not be correctable.
11.9. Reinstatement if your booking is cancelled. Cancellations follow the Service Provider's Booking Terms and Conditions. Where the Service Provider refunds us for your booking, we will reinstate the Points deducted in full within 7 Business Days. This includes where:
- (a) the Service Provider cancels your booking or cannot fulfil it, including because of overbooking;
- (b) your tickets are not delivered before the event because of a failure by the Service Provider; or
- (c) the event is cancelled and the Service Provider refunds the booking. Where an event is changed or cancelled because of events beyond the Service Provider's control (as defined in clause 4 of its Booking Terms and Conditions) and the Service Provider does not give a refund, your Points will not be reinstated.
11.10. Postponed or rescheduled events. Event and fixture dates can change for reasons outside our or the Service Provider's control, including television scheduling, competition conflicts or decisions by a governing body or organiser. Your booking is for access to the event itself, not a specific date. If an event is rescheduled, your booking moves to the new date. If you cannot attend the new date, the Service Provider will use reasonable endeavours to resell your package on your behalf, but resale cannot be guaranteed. If your package is resold, we will reinstate your Points in full within 7 Business Days. If it is not resold, your Points will not be reinstated, and no Points will be reinstated solely because the date has changed. This follows clause 16A of the Service Provider's Booking Terms and Conditions.
11.11. No cancellations by you. Once you have submitted a request and your booking has been confirmed, the redemption is final. If you cancel, decide not to attend or cannot attend, your Points will not be reinstated. Any changes you ask for after confirmation, such as changing a guest's name, are at the Service Provider's discretion and may be subject to its amendment fees, which you pay directly to the Service Provider.
11.12. Changes to your account after booking. Once a booking is confirmed, the redemption stands even if your Credit Account later falls into arrears or is closed. Any amount you owe us will still be collected under your Credit Agreement. Clauses 5, 6 and 9 of the Rewards Terms continue to apply to any Points you have not redeemed.
11.13. No cash alternative. Experiences cannot be exchanged for cash or transferred to another account, and no alternative reward is offered. Any travel, accommodation or other costs not included in the package are your responsibility, as set out in clause 6.1.
11.14. Your data. To process your request, we will share the details you give us (your name, business name, email address and phone number) with the Service Provider, as described in section 8.
11.15. Changes to Experiences. We may add, change or withdraw Experiences, or end the Experiences offering, at any time. This will not affect any booking that has already been confirmed.
